Getting laid off compresses about a month of financial decisions into roughly a week. The hard part of what to do financially after a layoff is not budgeting — it is that three separate clocks start on the same day you are least equipped to read fine print: your severance deadline, your health coverage election window, and your unemployment claim. Miss them and you lose money that was legally available to you. What follows is a triage order, not a pep talk.

The First 72 Hours: What to Do Financially After a Layoff

Do these five things before you rewrite your resume. They take an afternoon and they protect every decision that comes later.

Write down three dates. Your last day worked, your last day on payroll, and the last day your health coverage is active. These are frequently different. Coverage often ends on the last day of the month, but some plans end it the day you separate. Do not assume — ask.

Pull your documents before access is cut. Offer letter, severance agreement, latest pay stub, benefits summary, equity or option grant documents, PTO policy, and the employee handbook section on separation. If company email is already locked, request copies from HR in writing.

Put every question to HR in writing. Email creates a record. Phone calls do not.

Count your actual cash. Checking, savings, and any money market you can reach in two days. Exclude retirement accounts and credit limits — those are not cash.

Calculate your lean monthly number. Housing, utilities, food, insurance, transportation, minimum debt payments. Nothing else.

Worked example: you have $11,400 in reachable cash and a lean monthly number of $3,800. That is three months of runway before severance or unemployment. If severance is six weeks of gross pay at $7,500 gross, budget the net — call it $5,300 after withholding — which extends you to roughly four and a half months. That single number decides how aggressive your spending triage needs to be.

Review the Severance Agreement Before You Sign Anything

Severance is almost always offered in exchange for a release of claims. That is a legal trade, and the first version is rarely the only version.

You usually have more time than the meeting implied. Under the federal Older Workers Benefit Protection Act, workers age 40 and over must be given at least 21 days to consider an individual agreement (45 days for a group layoff) plus 7 days to revoke after signing. Under 40, there is no federal minimum — but you can still ask for time, and employers routinely grant it.

Ask these before signing:

Is severance paid as a lump sum or salary continuation? Continuation sometimes keeps benefits active longer, and it can change how your state treats unemployment eligibility.

Is accrued PTO paid out separately? In some states payout is required by law and should not be counted as part of the severance offer.

What happens to unvested equity, and how long is the option exercise window? Ninety days after separation is a common default and it can be negotiated.

Does the agreement include a non-compete, non-solicit, non-disparagement, or a confidentiality clause covering the terms themselves?

Will the company contest an unemployment claim? Ask them to state that the separation was a position elimination.

Are you eligible for rehire, and will they provide a neutral reference?

Counter-asks that employers often say yes to: a few extra weeks of pay, the employer covering COBRA premiums for two or three months, an extended option exercise window, and a written reference. If the agreement is long or the equity is meaningful, a flat-fee review by an employment attorney in your state is generally cheap relative to what is on the table. Nothing here is legal advice — it is a list of things to get answered before you sign.

Health Coverage: Compare Four Options on the Same Page

This is the decision people get wrong most often, because they compare monthly premiums and stop there.

COBRA. Same plan, same network, same deductible progress. You pay the full premium plus up to a 2% administrative fee, so the cost is usually a shock. You generally have 60 days to elect from the later of your coverage loss or your COBRA notice, and coverage is retroactive to the date you lost it if you elect and pay.

ACA Marketplace. Losing job-based coverage triggers a special enrollment period, typically 60 days. Subsidies are based on your estimated income for the year — and your income just changed, so estimate the new reality, not last year’s W-2.

A spouse’s or partner’s employer plan. Your loss of coverage usually opens a limited special enrollment window on their plan, often around 30 days. That window is shorter than the others, so check it first.

Medicaid. No enrollment window — you can apply any time, and eligibility in expansion states is based on current monthly income, which may now qualify you.

Compare on four lines, not one: monthly premium, deductible already met this year, whether your doctors and prescriptions are in network, and out-of-pocket maximum. The deductible line is the one that flips decisions. If you have already met a $3,000 deductible in September, a cheaper Marketplace plan resets you to zero for the rest of the year. COBRA at $650 a month can genuinely be the cheaper path through December.

One timing note worth knowing: because COBRA is retroactive within the election window, some people intentionally hold the decision open and elect only if a medical need arises. That works mechanically, but the payment deadlines are strict and an unpaid claim in the meantime is yours. Know the rules of your specific plan before relying on it.

Filing for Unemployment Without Losing Weeks

File in the state where you performed the work, which is not always the state where you live. File in the first week. Many states do not backdate a claim, and some have an unpaid waiting week that only starts once you file — waiting two weeks to „see how job hunting goes“ can cost you real money.

Have ready: Social Security number, a government ID, your employer’s legal name, address and FEIN (it is on your W-2), your exact employment dates, and gross earnings for the last 18 months. For reason for separation, the accurate answer is a layoff or position elimination. Do not write „quit.“

Then remember the part that trips people: filing the claim does not pay you. Weekly or biweekly certification does. Set a recurring calendar alarm for certification day and log any required work-search contacts as you make them, not from memory at the end of the week.

Report severance and PTO payouts honestly. Some states delay or offset benefits during the weeks severance covers, and the fix is simply to claim again once that period ends. If you are denied, appeal — deadlines are short, often in the range of 10 to 30 days — and keep certifying every week while the appeal is pending, or those weeks are gone even if you win.

Spending Triage: Pay in This Order

When cash is finite, order beats optimization. Tier one is shelter, utilities, food, insurance premiums, and the transportation that gets you to interviews. Tier two is minimum payments on secured debt — anything that can be repossessed or foreclosed. Tier three is minimums on unsecured debt. Everything else pauses.

Then make one pass through your statements and cancel or pause: subscriptions, unused memberships, scheduled extra debt payments, automated investing transfers, and any annual renewal landing in the next 90 days.

Call before you miss a payment, not after. Credit card hardship programs, mortgage forbearance, and utility deferral plans almost all require you to be current or barely late when you ask. If you have federal student loans, unemployment deferment exists and income-driven repayment can be recertified at your new income rather than last year’s.

Two things to avoid: cashing out a 401(k) as the first move, and using a credit card cash advance to cover a premium. If your old balance is under $7,000 the plan may force it out automatically, so tell them where to roll it. If you separated in or after the year you turned 55, penalty-free withdrawal rules from that employer’s plan may apply — confirm with a tax professional before touching anything, because the tax treatment is not something to guess at. Cash-flow walkthroughs on the Cursiqa blog go deeper on stretching a fixed pile of money across an unknown number of months.

When the Plan Breaks

The signing deadline arrives before your attorney can review. Email HR and ask for a short extension in writing. It is a normal request and often granted.

Unemployment is denied because of severance. That is usually timing, not permanent ineligibility. File again for the weeks after severance ends, and appeal within the deadline.

You elected COBRA and cannot afford it. Understand the trade first: exhausting COBRA opens a special enrollment period, while simply dropping it or letting it lapse generally does not. Check what window you would still have before you stop paying.

An offer arrives in week six. Do not cancel coverage until the new plan’s effective date is confirmed in writing. New-hire coverage frequently starts the first of the following month, not on day one.

If you want this whole sequence already assembled — the 72-hour checklist, the severance questions, the coverage comparison sheet and the triage worksheets in one place — the Layoff Financial Triage workbook is the ready-made version, and the rest of the Cursiqa shop covers the cash-flow and income-rebuild work that comes after. Either way, the order above is the part worth keeping.
",
